These Terms of Service govern access to and use of the SuperScout candidate-evaluation platform (the “Service”) by evaluators, administrators, and customer organizations. By accessing the Service you agree to these Terms.
1. Accounts & responsibility
Accounts are provisioned by an administrator. You are responsible for safeguarding your credentials and for all activity under your account, and must notify us promptly of any unauthorized use.
2. Acceptable use
Use the Service only for lawful candidate evaluation. Do not attempt to access data you are not authorized to see, probe or disrupt the Service, upload malware, or use candidate data for any purpose other than the selection process it was collected for.
3. Customer data & candidate information
Customer organizations own the candidate data they submit. We process it on their behalf to provide the Service, under the Privacy Policy and any Data Processing Agreement. Confidentiality, access controls, and audit logging apply.
4. AI assistance & no fully-automated decision
SuperScout uses AI to assist review and scoring. AI output may be incomplete or wrong and must not be relied on as the sole basis for any hiring decision. A human makes the final decision. Customers are responsible for lawful, non-discriminatory use and for any bias-audit / candidate-notice obligations that apply to automated employment decision tools.
5. Intellectual property
The Service, its software, and its trademarks are owned by PLS 3rd Learning. These Terms grant a limited, revocable, non-exclusive right to use the Service; no other rights are granted.
6. Disclaimers & limitation of liability
The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, PLS 3rd Learning disclaims implied warranties and limits its aggregate liability as set out here. [Liability cap and exclusions to be finalized by counsel.]
7. Indemnification, term & termination
Customer obligations, indemnities, suspension, and termination (including for breach of these Terms or unlawful use) are as set out in the applicable subscription agreement. [To be finalized by counsel.]
8. Support & service levels
Support and any service-level commitments are described in the customer subscription agreement, where applicable.
9. Changes & governing law
We may update these Terms; material changes require re-acceptance. Continued use after an update constitutes acceptance. These Terms are governed by the law of [Governing Law / Jurisdiction].
